Chapter 7 - LIGHT POLLUTION        Article 1 - General Provisions

49-1101. Definitions

In this article, unless the context otherwise requires:

1. "Fully shielded" means that fixtures are shielded in such a manner that light rays emitted by the fixture, either directly from the lamp or indirectly from the fixture, are projected below a horizontal plane running through the lowest point on the fixture where light is emitted.

2. "Outdoor light fixture" means outdoor artificial illuminating devices, lamps and other devices, permanent or portable, used for illumination or advertisement. Such devices shall include, but are not limited to, search, spot or flood lights for buildings and structures, recreational areas, parking lot lighting, landscape lighting, billboards and other signage and street lighting.

3. "Partially shielded" means that fixtures are shielded in such a manner that the bottom edge of the shield is below the plane of the center line of the lamp reducing light above the horizontal.

 

49-1102.** Shielding of outdoor light fixtures

All outdoor light fixtures shall be fully or partially shielded except incandescent fixtures of one hundred fifty watts or less and other sources of seventy watts or less. Streetlight fixtures are exempt from this requirement if the shielding is not available from the manufacturer.


49-1103. Nonconforming light fixtures

In addition to other exemptions provided in this article, outdoor light fixtures not meeting the provisions of this article shall be allowed provided such fixtures are extinguished between the hours of midnight and sunrise by an automatic shutoff device.


49-1104. Use of mercury vapor light fixtures

A. No new mercury vapor outdoor light fixtures shall be installed after the effective date of this section. No replacement equipment other than bulbs for mercury vapor lighting fixtures shall be sold in the state after January 1, 1991 and the use of mercury vapor light fixtures is prohibited after January 1, 2011.

B. The provisions of this section shall not apply to outdoor light systems erected prior to 1950


49-1105. Airport lighting

Nothing in this article shall apply to navigational lighting systems at airports


49-1106.** Exemption of cities, towns and counties

The provisions of this article are cumulative and supplemental and shall not apply within any county, city or town which by ordinance or resolution has adopted provisions restricting light pollution which are equal to or more stringent than the provisions of this chapter.

 AN ACT

AMENDING TITLE 9, CHAPTER 4, ARTICLE 8, ARIZONA REVISED STATUTES, BY ADDING SECTION 9-499.11; AMENDING TITLE 34, CHAPTER 4, ARIZONA REVISED STATUTES, BY ADDING ARTICLE 5; AMENDING SECTION 49-1102, ARIZONA REVISED STATUTES; RELATING TO LIGHTING STANDARDS.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-499.11, to read:

9-499.11. Lighting standards for municipal buildings; life cycle costing; evaluation standards; shielding

A. A CITY OR TOWN WITH A POPULATION OF FIFTY THOUSAND OR MORE PERSONS SHALL PROVIDE FOR EFFICIENT AND EFFECTIVE LIGHTING SYSTEMS FOR NEW CONSTRUCTION AND MAJOR RENOVATIONS OF MUNICIPAL BUILDINGS, STRUCTURES, FACILITIES AND AREAS AS DETERMINED BY AN EVALUATION BASED ON THE ILLUMINATING ENGINEERING SOCIETY OF NORTH AMERICA LIGHTING HANDBOOK AND RECOMMENDED PRACTICES.

B. LIFE CYCLE COSTS AS DEFINED IN SECTION 34-454 SHALL BE USED TO EVALUATE THE DESIGN, EQUIPMENT AND MATERIALS THAT ARE CONSIDERED PURSUANT TO SUBSECTION A OF THIS SECTION.

C. ALL OUTDOOR LIGHT FIXTURES THAT ARE OWNED AND OPERATED BY A CITY OR TOWN AND THAT ARE SUBJECT TO THE REQUIREMENTS OF SUBSECTION A OF THIS SECTION SHALL BE FULLY SHIELDED AS DEFINED IN SECTION 49-1101, EXCEPT THAT OUTDOOR LIGHT FIXTURES FOR A MUNICIPAL RECREATIONAL AREA OR MUNICIPAL SPORTS FACILITY SHALL BE FULLY OR PARTIALLY SHIELDED AS DEFINED IN SECTION 49-1101. THIS SUBSECTION DOES NOT APPLY TO THOSE OUTDOOR LIGHT FIXTURES THAT ARE NOT REQUIRED TO BE SHIELDED PURSUANT TO SECTION 49-1102.

Sec. 2. Title 34, chapter 4, Arizona Revised Statutes, is amended by adding article 5, to read:

ARTICLE 5. LIGHTING STANDARDS FOR STATE

34-471. Lighting standards for state buildings; life cycle costing; evaluation standards; shielding

A. ALL NEW STATE CAPITAL PROJECTS AS DEFINED IN SECTION 41-790, INCLUDING BUILDINGS DESIGNED AND CONSTRUCTED BY THE DEPARTMENT OF ADMINISTRATION, THE DEPARTMENT OF TRANSPORTATION, COMMUNITY COLLEGE DISTRICTS AND UNIVERSITIES AND MAJOR RENOVATIONS FOR THOSE ENTITIES INVOLVING LIGHTING SYSTEMS, SHALL INCLUDE EFFICIENT AND EFFECTIVE LIGHTING SYSTEMS AS DETERMINED BY AN EVALUATION BASED ON THE ILLUMINATING ENGINEERING SOCIETY OF NORTH AMERICA LIGHTING HANDBOOK AND RECOMMENDED PRACTICES.

B. LIFE CYCLE COSTS AS DEFINED IN SECTION 34-454 SHALL BE USED TO EVALUATE THE DESIGN, EQUIPMENT AND MATERIALS THAT ARE CONSIDERED PURSUANT TO SUBSECTION A OF THIS SECTION.

C. ALL OUTDOOR LIGHT FIXTURES THAT ARE OWNED AND OPERATED BY THIS STATE AND THAT ARE SUBJECT TO THE REQUIREMENTS OF SUBSECTION A OF THIS SECTION SHALL BE FULLY SHIELDED AS DEFINED IN SECTION 49-1101, EXCEPT THAT OUTDOOR LIGHT FIXTURES THAT ARE USED TO ILLUMINATE SPORTS FACILITIES THAT ARE USED BY AN EDUCATIONAL INSTITUTION SHALL BE FULLY OR PARTIALLY SHIELDED AS DEFINED IN SECTION 49-1101. THIS SUBSECTION DOES NOT APPLY TO THOSE OUTDOOR LIGHT FIXTURES THAT ARE NOT REQUIRED TO BE SHIELDED PURSUANT TO SECTION 49-1102.

34-472. Exemptions

THIS ARTICLE DOES NOT APPLY TO:

1. ANY COUNTY, CITY OR TOWN.

2. PROGRAMS, PROJECTS OR IMPROVEMENTS OF THE STATE TRANSPORTATION BOARD RELATING TO THE CONSTRUCTION, RECONSTRUCTION, IMPROVEMENT OR MAINTENANCE OF STATE HIGHWAYS OR BRIDGES AND INTERSTATE SYSTEM HIGHWAYS.

3. CONSTRUCTION OR MAJOR RENOVATION OF THE STATE CAPITOL BUILDING AS DEFINED IN SECTION 41-790.

Sec. 3. Section 49-1102, Arizona Revised Statutes, is amended to read:

49-1102. Shielding of outdoor light fixtures; exemption

A. All outdoor light fixtures shall be fully or partially shielded except incandescent fixtures of one hundred fifty watts or less and other sources of seventy watts or less. Streetlight fixtures are exempt from this requirement if the shielding is not available from the manufacturer.

B. THIS SECTION DOES NOT APPLY TO EMERGENCY LIGHTING THAT IS USED BY POLICE, FIRE FIGHTERS, CORRECTIONAL PERSONNEL OR MEDICAL PERSONNEL AND THAT IS IN OPERATION AS LONG AS THE EMERGENCY EXISTS.

C. ALL OUTDOOR LIGHTING USED FOR PROGRAMS, PROJECTS OR IMPROVEMENTS OF A CITY OR TOWN RELATING TO THE CONSTRUCTION, RECONSTRUCTION, IMPROVEMENT OR MAINTENANCE OF A STREET OR HIGHWAY ARE EXEMPT.

D. ALL OUTDOOR LIGHTING USED FOR CONSTRUCTION OR MAJOR RENOVATION OF MUNICIPAL BUILDINGS, STRUCTURES AND FACILITIES OF A CITY OR TOWN ARE EXEMPT.

49-1106. Exemption of cities, towns and counties

A. EXCEPT AS PROVIDED IN SUBSECTION B, the provisions of this article are cumulative and supplemental and shall not apply within any county, city or town which by ordinance or resolution has adopted provisions restricting light pollution which are equal to or more stringent than the provisions of this chapter ARTICLE.

B. FOR ANY CITY OR TOWN WITH A POPULATION OF FIFTY THOUSAND OR MORE PERSONS BEFORE JANUARY 1, 2004, THE CITY OR TOWN SHALL ADOPT AN ORDINANCE THAT REGULATES OUTDOOR LIGHT FIXTURES. THE ORDINANCE SHALL REQUIRE THAT OUTDOOR LIGHT FIXTURE LIGHT LEVELS ON THE EFFECTIVE DATE OF THIS AMENDMENT TO THIS SECTION BE REDUCED BY TEN PER CENT BEFORE JANUARY 1, 2006.

 

Arizona SB 1330

Section 1. Title 34, chapter 4, Arizona Revised Statutes, is amended by adding article 5, to read:

CAPITAL PROJECTS AS DEFINED IN SECTION 41-790, INCLUDING BUILDINGS DESIGNED AND CONSTRUCTED BY THE DEPARTMENT OF ADMINISTRATION, THE DEPARTMENT OF TRANSPORTATION, COMMUNITY COLLEGE DISTRICTS AND UNIVERSITIES AND MAJOR RENOVATIONS FOR THOSE ENTITIES OVER SIX THOUSAND SQUARE FEET, SHALL INCLUDE EFFICIENT AND EFFECTIVE LIGHTING SYSTEMS AS DETERMINED BY AN EVALUATION BASED ON THE ILLUMINATING ENGINEERING SOCIETY OF NORTH AMERICA LIGHTING HANDBOOK.

B. LIFE CYCLE COSTS AS DEFINED IN SECTION 34-454 SHALL BE USED TO EVALUATE THE DESIGN, EQUIPMENT AND MATERIALS THAT ARE CONSIDERED PURSUANT TO SUBSECTION A OF THIS SECTION.

C. EXCEPT FOR LIGHT FIXTURES THAT CONTAIN LOW PRESSURE SODIUM LAMPS, ALL OUTDOOR LIGHT FIXTURES OWNED AND OPERATED BY THE STATE SUBJECT TO THE REQUIREMENTS OF SUBSECTION A OF THIS SECTION, SHALL BE FULLY SHIELDED, AS DEFINED IN SECTION 49-1101.

D. THE PROVISIONS OF THIS ARTICLE DO NOT APPLY TO ANY COUNTY, CITY OR TOWN.

49-1102. Shielding of outdoor light fixtures

All outdoor light fixtures shall be fully or partially shielded except incandescent fixtures of one hundred fifty watts or less and other sources of seventy watts or less. Streetlight fixtures are exempt from this requirement if the shielding is not available from the manufacturer. THIS REQUIREMENT APPLIES TO STREETLIGHT FIXTURES THAT ARE NOT LOCATED WITHIN A HISTORICAL DISTRICT AND THAT ARE INSTALLED AFTER THE EFFECTIVE DATE OF THIS AMENDMENT TO THIS SECTION.
